I am the co-owner in property bearing CTS 2687 situated in Chikhalwadi area on Sachkhand Road, Nanded. Adjoining owner of CTS 2689 has constructed a four storied structure abutting my building on the western side, which is in violation of the permission granted to him and in excess of approved area. I had complained about the illegal construction firstly in the month of August 2013. Thereafter, I made various representations to the Municipal Corporation Nanded. There was no action on their part. So I filed representation before the Lok Ayukta who in turn enquired with the Municipal Corporation regarding the illegal construction. In its reply to communication by the Lok Ayukta in this regard, the Municipal Corporation on 28 May 2014 stated that an inspection was carried out. It is mentioned that construction admeasuring 50 sq. mts. was in excess of the permission granted and that action on the same was proposed. However, the same letter mentions that the construction is not unauthorised or illegal. The letter goes on to mention that the builder has applied for Completion Certificate. Occupancy Certificate has not yet been given. Yet, people have started using their units for residential purposes. Meanwhile in answer to my application filed under RTI, I was informed that no panchnama was carried out regarding the construction by the Municipal Corporation. My applications regarding the proposed action etc were answered with the statement that there is no provision in RTI Act regarding interrogative queries and that only copies of documents relevant to the subject can be supplied. My grievance is regarding the gross violation of provisions of the MRTP Act, particularly as regards side margins and open spaces in the newly constructed Building and denial of access to me towards western and southern side of my building for maintenance purpose like colouring of building or drainage repair etc.
The said building was inaugurated in the presence of the then Municipal Commissioner against whom I have filed complaint before the Lok Ayukta for his complicity in the illegal construction by the builder. I have also submitted complaint against the then Municipal Commissioner to the CVC, NewDelhi,Chief Information Commissioner and the Secretary of Urban Development Department, State of Maharashtra. Since the date of my complaint, there has been no hindrance in the construction activities evidently because the builder has somehow managed the Municipal Corporation so that no action is taken at all, even though the construction is apparently illegal. No action is yet taken regarding the excess construction which the Municipal Corporation claims to be only 50 sq. mts. In fact, real measurement will reveal that there is far more construction in excess of the permission granted. There is open flouting of all the rules and norms. Many of the conditions subject to which the permission was granted have not been complied with.

It is therefore necessary that a panchnama be carried out.

Despite the diligent efforts on my part to bring to the notice of authorities the illegalities committed by owner and the builder, no action has been taken.

Hoping you will personally look in to the matter and direct the concerned to probe against the large scale corruption done by the officers of Nanded Waghala City municipal corporation particularly from the Encroachment Department who are hand in glove with the Builders lobby and are very grossly violating the laid down norms for vested interests and monetary gains at expense of public and the society at the large.

As I have complained to higher authorities , I fear the Builders lobby will hurt me and my family as the builders lobby is strong and has political and financial backing . Then Municipal Commissioner,then Municipal Additional Commissioner and Assistant Commissioner of Encroachment Department all these officers I believe are beneficiary of the monetary gains from the builder and property owner because these were the competent authority to check the illegalities done by the Builder and the owner but they never acted on my repeated complaints due to their vested interests and are responsible for criminal misconduct due to corruption and misuse of official position for favouring the builders against the prevailing law.
Hoping you will personally look in to the matter and direct the concerned to probe against the large scale corruption done by the officers of Nanded Waghala City municipal corporation who are hand in glove with the Builders lobby and are very grossly violating the laid down norms for vested interests & monetary gains at expense of public and the society at the large by misusing official position and power.
