The police do have a right to check you on the road for consumption of alcohol. However, you have a right to check the breathalyser test results too. I am told that sometimes the results also vary. It is best not to drink anything, in such circumstances. Finally, if you are under the influence and above the limit, Please insist on paying the fine and collecting a receipt for it.

Do the police have a right to just walk up to you and ask for a breath test without any cause . i ask because this happened to me,i had just come out of a party where i had only "one" beer and was driving home , a cop loittering around the inner ring road signal , just walking up to cars and biker and insisting on a spot breat test , eventually he came to my car and did the same , after i obliged he just said "alcohol , you must pay fine" now i know i was not drunk and not driving rashly and this cop was just radomly picking on people , despite argument and to avoid a courtcase which he kept threateningme with,i was forced to pay him 900 Rs . this dosn;t seem right , in fact it feels like harrasment to me . is this allowed ?
